1. THE ASSET
For this License, the "Asset" means the specific Stripa digital product identified in the purchase or download through which this License was obtained, including the files and formats expressly supplied as part of that product.
For Stripa Loader 01, the Asset may include Lottie JSON animation files, MOV animation files, and related documentation supplied with the product.
A license for one Asset does not grant rights to other Stripa products, later products, future releases, or separate assets.
2. GENERAL LICENSE TERMS
The Asset is licensed, not sold. Copyright and all ownership rights in the Asset remain with Sinka Peter Balint.
The license granted to you is non-exclusive and non-transferable.
The scope of your permitted use depends on the license level obtained with the Asset:
- Personal License
- Commercial License
- Special License
Special Licenses are individually negotiated and are not granted automatically under this document.
You may modify the Asset only as permitted by the applicable license and only for use within permitted projects or End Products. Modification does not transfer ownership of the Asset or create a right to sell, sublicense, redistribute, or repackage the Asset itself.
3. PERSONAL LICENSE
A Personal License permits a natural person to use the Asset in unlimited genuinely personal and non-commercial creative projects.
Permitted examples include personal videos, experimental motion graphics, personal websites, social media posts, student work, learning, testing, prototypes, and other projects that are not created for business, professional, promotional, fundraising, client-acquisition, or profit-oriented purposes.
Public sharing of finished personal work is permitted and encouraged.
You may use the Asset across multiple personal projects and platforms.
You may recolor, resize, retime, crop, composite, convert, or otherwise adapt the Asset for a permitted personal project, subject to the restrictions in this License.
4. ORGANIC SUCCESS AND INCIDENTAL REVENUE
A project that was genuinely created as a personal, non-commercial project does not automatically become commercial merely because it later becomes popular or successful.
Passive platform advertising revenue or similar incidental revenue arising later from an originally personal project does not by itself invalidate the Personal License.
However, a new project deliberately created for profit, promotion, fundraising, Patreon or membership support, client acquisition, business activity, or the promotion or sale of a person, product, service, organization, event, or brand is not Personal Use.
5. NON-COMMERCIAL HOBBY PRODUCTS
A free hobby project created by a natural person may qualify as Personal Use when it is genuinely non-commercial and contains no advertising, paid access, in-app purchases, commercial sponsorship, fundraising purpose, or other commercial intent.
This may include, for example, a genuinely non-commercial hobby game.
Publication of a free application or other software product does not automatically qualify as Personal Use. Where the Asset is embedded in an application, software product, game, service, or system as a functional, recurring, or substantial component, a Special License may be required under Section 10.
6. COMMERCIAL LICENSE
A Commercial License permits the Asset to be used as a creative tool or component in unlimited commercial and professional creative projects, subject to this License.
There is no standard limit under the Commercial License based solely on the number of projects, clients, campaigns, viewers, users, audience size, project budget, revenue, or commercial success.
Permitted examples include:
- paid client videos and advertising;
- commercial films and music videos;
- business social media content;
- professional portfolio work used to obtain clients;
- company advertising and promotional content;
- finished visual content for websites;
- museum, exhibition, concert, event, or festival visuals;
- other finished creative works in which the Asset is a component rather than the product itself.
A Commercial License does not permit embedded, system-level, product-level, template, stock, asset-library, or standalone-asset use unless expressly allowed by a Special License.
7. END PRODUCTS
An "End Product" is a finished creative work in which the Asset has been incorporated and is not offered to the recipient as a reusable standalone asset.
Examples include a rendered video, advertisement, film, music video, finished social media creative, finished website presentation, exhibition visual, or other completed creative work.
You may create, publish, distribute, broadcast, display, deliver, and sell permitted End Products under the Commercial License.
You may make money from the End Product.
You may not sell, sublicense, redistribute, or otherwise provide the Asset itself as a reusable asset.
End Product rights are not Asset rights.
8. CLIENT WORK
A Commercial License holder may use the Asset to create permitted End Products for clients.
The license holder may deliver the finished End Product to the client. The client may publish, distribute, broadcast, or display that finished End Product without obtaining a separate Stripa license solely for those uses.
This does not transfer rights in the Asset to the client.
If the client wants independent access to the Asset, wants to reuse or modify the Asset, wants to create new projects with it, or wants to integrate it into a product, application, service, system, template, or other reusable environment, the client must obtain an appropriate Stripa license.
9. TECHNICAL ACCESSIBILITY
Where a permitted website or web-based End Product technically requires a JSON or similar Asset file to be delivered to a user's browser, that technical accessibility alone is not treated as prohibited redistribution, provided that:
- the Asset is used only as part of the permitted End Product;
- the Asset is not intentionally offered, packaged, indexed, marketed, or presented for independent reuse or download; and
- the website or End Product is not itself a template, asset library, development resource, or competing digital asset product.
10. SPECIAL LICENSE
A Special License is required when the intended use exceeds the Commercial License or when the Asset becomes an integrated, functional, recurring, substantial, or product-level component of another product, application, service, system, platform, or visual identity.
Examples may include:
- native applications and app user interfaces;
- SaaS products and recurring software interfaces;
- commercial games;
- recurring television or broadcast graphic systems;
- chain or franchise systems;
- hardware and embedded systems;
- vehicle or manufactured-product integration;
- product-level interfaces;
- large recurring branded systems;
- other uses in which the Asset functions as part of the product or system itself rather than merely as a component of a finished creative End Product.
Special Licenses are individually negotiated. Their terms may define scope, duration, territory, fee, royalty, modification rights, distribution rights, installation rights, or other conditions.
The number of employees, users, downloads, installations, locations, viewers, or the amount of revenue does not by itself determine whether a Special License is required. The nature and purpose of the use are the primary factors.
Contact spb@stripastrap.com before using the Asset in a use case requiring a Special License.
11. PROHIBITED REDISTRIBUTION AND RESALE
Under the Personal and Commercial Licenses, you may not:
- sell, sublicense, redistribute, share, transfer, publish, give away, or otherwise make the Asset available as a standalone digital asset;
- provide the source files to another person or organization for independent reuse;
- upload the Asset to a stock library, asset library, marketplace, repository, download collection, or similar service for reuse by others;
- include the Asset in an asset pack or collection;
- repackage the Asset for resale or redistribution;
- claim authorship or ownership of the Asset.
These restrictions apply whether the Asset is distributed for payment or free of charge.
12. TEMPLATES AND REUSABLE PRODUCTS
The Personal and Commercial Licenses do not permit the Asset to be distributed as part of a reusable template, theme, toolkit, motion graphics template, video template, design template, editing template, development template, or similar reusable product.
This includes, without limitation, templates for Adobe After Effects, Adobe Premiere Pro, DaVinci Resolve, websites, applications, presentations, streaming packages, and other systems where the recipient can extract, reuse, replace, modify, or independently deploy the Asset.
Such use requires separate written permission or a Special License.
13. MODIFICATION AND DERIVATIVE ASSETS
You may modify the Asset for use within a project permitted by your license.
Permitted modifications may include recoloring, resizing, retiming, cropping, compositing, format conversion, and other project-specific adaptations.
You may not sell, sublicense, distribute, share, or give away a modified version of the Asset as a standalone or reusable digital asset.
You may not use the Asset's source geometry, animation data, vector structure, motion data, or supplied source files to create a derivative standalone digital asset for sale, licensing, redistribution, or free distribution.
Modification does not create independent ownership rights in the underlying Asset.
Nothing in this License is intended to claim exclusive rights over abstract ideas, general concepts, methods, or styles that are not protected by applicable intellectual property law.
14. RESERVED USES
The following uses are reserved by the Copyright Owner and are not granted under the standard Personal or Commercial Licenses:
- merchandise incorporating the Asset or Stripa visual system as a primary design element;
- commercial watch faces;
- clock products;
- timer products;
- countdown products in which the Stripa visual system is a primary product feature;
- standalone loader products;
- standalone commercial digital assets extending or reproducing the Stripa visual language;
- use by watch manufacturers where the Asset or Stripa visual system is integrated into a watch, watch interface, watch software, watch face, product presentation system, or related product-level experience.
Reserved does not mean permanently prohibited. The Copyright Owner may choose to authorize a reserved use under a separately negotiated Special License or other written agreement.
15. LICENSE UPGRADES
If your intended use exceeds your current license, you must obtain the appropriate license before beginning that new use.
A Personal License may be upgraded to a Commercial License where offered.
Uses requiring a Special License must be agreed separately in writing.
Obtaining a broader license does not transfer copyright ownership of the Asset.
16. DURATION
Subject to compliance with this License, Personal and Commercial Licenses are perpetual for uses permitted by the license obtained.
No recurring royalty or annual renewal is required under the standard Personal or Commercial License unless expressly stated in the purchase terms for a particular transaction.
A Special License may have different duration or payment terms as stated in the individual agreement.
17. LICENSE VERSION
The license version identified at the time of purchase or valid acquisition applies to that license grant.
Later versions of the Stripa Digital Asset License do not automatically reduce rights already validly granted under an earlier version.
A later license version may apply to later purchases, later products, or a separately agreed license upgrade.
18. NO TRANSFER OF ASSET RIGHTS
No Personal or Commercial License transfers copyright, authorship, title, or ownership of the Asset.
You receive only the usage rights expressly granted by the applicable license.
End Product rights are not Asset rights.
19. ATTRIBUTION
Attribution is not required under the standard Personal or Commercial License unless expressly stated in the purchase terms for a particular Asset.
When attribution is voluntarily provided, the suggested credit is:
Stripa Digital / stripastrap.com
20. MATERIAL BREACH AND TERMINATION
Your license rights depend on compliance with this License.
If you materially breach this License, the rights granted under it may terminate to the extent permitted by applicable law.
Where the breach can reasonably be cured, you should stop the non-compliant use and cure the breach promptly after becoming aware of it or receiving notice.
Termination does not transfer ownership of the Asset and does not affect rights or remedies that cannot lawfully be excluded.
21. MANDATORY RIGHTS
Nothing in this License excludes, restricts, or overrides rights, remedies, guarantees, or protections that cannot lawfully be excluded or limited under applicable law.
Where the licensee is a consumer, mandatory consumer-protection rules remain applicable where required by law.
22. DIGITAL CONTENT AND CONFORMITY
Where mandatory consumer law applies to the supply of the Asset as digital content, the Licensor or seller will provide the rights and remedies required by applicable law, including mandatory rights relating to supply and conformity.
Nothing in this License is intended to waive mandatory statutory remedies for digital content.
23. SEVERABILITY
If any provision of this License is found to be invalid, illegal, or unenforceable, the remaining provisions remain in effect to the extent permitted by applicable law.
The invalid or unenforceable provision will be interpreted or limited only to the extent necessary to make it enforceable where permitted by law.
24. GOVERNING LAW
This License is governed by the laws of Hungary, without prejudice to mandatory rules that apply regardless of the chosen law.
For consumer contracts, this choice of law does not deprive a consumer of mandatory protections that apply under the law that would govern the consumer contract in the absence of this choice where applicable.
25. JURISDICTION
Disputes relating to this License will be handled by the courts having jurisdiction under applicable law.
Nothing in this License is intended to remove a consumer's right to bring or defend proceedings in a court available to that consumer under mandatory applicable law.
26. ENTIRE LICENSE
This document, together with the specific license level and product information identified in the relevant purchase or download, constitutes the license terms governing use of the Asset unless a separate written agreement applies.
A Special License or other separately signed written agreement may modify or replace these terms for the use expressly covered by that agreement.
